*Club Rules*

Please take note of our club rules to ensure everyone is comfortable in our facility

*General Safety*
Please ensure the door is closed securely upon entry and exit.
Please be mindful of tripping hazards like weights on the floor, etc.
Please be mindful of others around you when handling the long barbells, and skipping ropes.
Shoes to be worn at all times to prevent injury.
Children are not permitted on equipment or on the class floor due to risk of injury.
Ensure you always have a spotter nearby for the bench press station and weighted squat station.

*Hygiene*
Please be considerate of others and use a sweat towel when using mats and machines.
Please wipe sweat up after yourself - feel free to use the sanitizer and cloths provided.
If you are sick please stay at home until you are better.
Shoes to be worn at all times unless instructed.

*General Rules*

Please don't throw weights on the floor or other equipment.
If a machine does not feel or sound right please report it.

Please leave the bathroom in a manner in which you would like to use it.

Unauthorised personal training is prohibited for the safety of all members.

1. Credit Card Payments

The fees and charges quoted by Shapes for Women and/or stipulated to the Member do not include any interest or additional charges that may be applied by the cardholder’s bank arising from the use of a credit card for this transaction.

2. Debit Order Authorisation

The Member authorises Shapes for Women to issue payment instructions to their bank for collection against the Member’s nominated account (or any account to which it may be transferred), provided that such payments do not exceed the Member’s agreed obligations. If the Member’s account falls into arrears, Shapes for Women is authorised to debit the full arrears together with the next monthly instalment.

3. Member Declaration

The Member confirms that: The contract has been completed in full, All information provided is accurate and true.

4. Indemnity

The Member indemnifies Shapes for Women, its owners, shareholders, employees, agents, and representatives against any claims, damages, losses, or expenses (including attorney-and-client legal fees) arising directly or indirectly from: Injury or death, Participation in exercise programs, Training (supervised or unsupervised), Use of equipment or facilities. This includes incidents that may be attributed to negligence.

5. Cooling-Off Period (Direct Marketing)

If the Member was approached through direct marketing, they may cancel the Membership within five (5) days of signing (excluding the day of signature, weekends, and public holidays).
Cancellation must be submitted in writing or another recordable form

Shapes for Women will refund payments within 15 days. No penalty applies, but a reasonable fee may be charged for services used during this period.

6. Refund Policy

Except as stated in clause 5, all joining fees are strictly non-refundable.

7. Fee Adjustments

After the initial fixed term, monthly fees may increase annually at the sole discretion of Shapes for Women.

8. Cancellation by Member

The Member may cancel the Agreement at any time by giving 20 business days’ written notice.

An early cancellation fee will apply, calculated as: Arrears + 1 calendar month notice + 30% of the remaining contract balance

Conditions:

Cancellation is only effective once all outstanding amounts are paid. Failure to pay may result in the cancellation request being declined. The Agreement will continue if cancellation is not properly completed. It is the Member’s responsibility to ensure notice is received

9. Automatic Renewal

Shapes for Women will notify the Member between 40 and 80 business days before the expiry of the fixed term.

Unless: The Member cancels at least 20 business days before expiry, or Agrees to renew
…the Agreement will automatically continue on a month-to-month basis, subject to any communicated changes.

10. Fitness Warranty

The Member confirms they are in a suitable mental and physical condition to safely use the club facilities.

11. Payment Obligations

The Member agrees to pay all amounts due regardless of usage, including in cases of: Injury, Ill health, Voluntary non-use. Exception: Hospitalisation or death.

12. Late Payments & Fees

Interest will be charged at prime rate + 2% per annum on overdue amounts. Interest is calculated from due date until payment is received

The Member is liable for all dishonoured payment fees (e.g. returned debits/cheques)

13. Access Restriction

Access to the club will be denied until all outstanding amounts, including: Arrears, Penalties, Interest, Legal costs
…have been paid in full.

14. No Inducement

The Member confirms they were not induced into this Agreement by any representations not contained within this document.

15. Member Responsibilities

The Member must notify Shapes for Women of any changes to:

Address
Contact details
Personal particulars
Banking details

Failure to do so may result in the Member being liable for tracing costs.

16. Breach of Agreement

Shapes for Women may cancel the Agreement after 20 business days’ notice if the Member fails to remedy a material breach.

17. Cession of Rights

Shapes for Women may transfer or assign its rights under this Agreement without notice. The Member remains bound by the Agreement.

18. Domicilium (Legal Notices)

All legal notices will be sent to the addresses provided by the parties. Notices sent by registered post will be deemed received within 7 days

19. Amendments

No changes to this Agreement will be valid unless: Made in writing, and Signed by all parties
